Understanding Mississippi's Uninsured Motorists Laws

If you have uninsured/underinsured motorist coverage on your vehicle (and you should), you may think that you will be provided coverage for all of your injuries no matter what. Unfortunately, the insurance lobby made it much more difficult for you to get what you pay for in Mississippi.

Mississippi Uninsured/Underinsured Motorist Coverage 

Mississippi Code 83-11-103 provides, in part, that an uninsured motor vehicle is,

"An insured motor vehicle, when the liability insurer of such vehicle has provided limits of bodily injury liability for its insured which are less than the limits applicable to the injured person provided under his uninsured motorist coverage. . . ."

This means that in order for you to have uninsured motorist coverage, the limits of that UM coverage must greater than the liability limits of the person who injured you. That's right. Even if you have severe injuries and you paid for UM coverage on your vehicle, you may not be allowed to use that insurance. This is why it is so important to carry high limits of UM coverage on your vehicles. UM coverage is generally inexpensive for the amount of insurance you receive. Having higher limits will also protect you and your family from being denied the insurance coverage you pay for each policy period. 

Insurance companies reportedly spent over $150 million in 2016 influencing state and federal legislatures to write laws which reduce what they pay under the policies Americans purchase. Protect yourself and increase your uninsured motorist coverage limits.
